What other terms must a User follow in addition to this Accord, according to the Vendor?

a.    Throughout to this Accord, Vendors are obligated by applicable Indian laws, along with, including without limitation, the following laws:

·      Food Safety and Standard (Packaging and Labeling) Regulation of 2011 and the Food Safety and Standard Act of 2006 (FSS Packaging Regulation) Food Safety and Standard (Food Product Standard and Food Addictive) Regulation, 2011, and Food Safety and Standard (Food or Health Supplements, Nutraceuticals, Food for Special Medical Purpose, Functional Food, and Novel Food) Regulation, 2016, both of which are known as the FSS Standard Regulations (FSS Supplement Regulation).

·      Pharmaceuticals and Cosmetic Rules, 1945 (D&C Rules), and the Drugs and Cosmetics Act, 1940.

·      The Legal Metrology Act, 2009 and Legal Metrology (Packaged Commodities) Rules, 2011 (Packaging Rules);

b.    The Company is aware that the Vendor has a responsibility to make sure that the packaging in which the goods are sold fully complied with labeling and packaging and packing necessities and any other laws that may be prescribed in this regard, in accordance with the above statutes and regulations and any other relevant laws in effect during the term of this association. As a result, Vendor is solely responsible for adhering to legal requirements, and the Company shall in no way be liable. Vendors must hold Company and Platform harmless from any harm or loss resulting from breaking the aforementioned rules or other applicable laws.

c   By posting  or listing their products  for sale on the portal, the sellers guarantee that they will be able to do so legitimately and that the listed goods do not violate any third parties' intellectual property, trade marks, other ownership rights, rights of publicity, or rights to privacy. Users and Sellers concur that the Company is not liable for any violations of the same.
